Virginia's reconciled HB 642 creates a direct pathway for veterans to enter the cannabis industry as Impact Licensees — with a dedicated lottery, a two-bite selection rule, access to the Cannabis Equity Business Loan Fund, and up to 100 early microbusiness licenses by December 1, 2026.
Under the Impact License framework, applicants whose ownership is at least 66% held by qualifying individuals receive significant advantages. Qualification is a two-part test: first, meet the geographic residency prong, then satisfy at least one of six personal criteria — and veteran status counts.
That means a veteran who lived in a disproportionately policed jurisdiction (1999–2025) or a historically economically disadvantaged community (3 of last 5 years) already qualifies — veteran status alone satisfies the personal criterion.

HB 642 has passed
The reconciled HB 642 (HB642H3) passed both chambers on March 14, 2026 and has been sent to Governor Spanberger, who has signaled she will sign it. The bill establishes Virginia's framework for a regulated adult-use cannabis market: applications open September 1, 2026, with up to 100 early microbusiness licenses issued by December 1 and full retail sales commencing January 1, 2027.
Retail licenses are capped at 350 statewide before January 1, 2028, along with 25 wholesaler, 60 manufacturing, and 5 Tier V cultivation licenses. Cannabis will be subject to a 6% excise tax, 5.3% retail sales tax, and up to 3.5% local tax. A Cannabis Equity Business Loan Fund will provide grants, low-interest loans, and technical assistance to qualified impact licensees. Existing pharmaceutical processors must pay a conversion fee (reported at approximately $10 million in the reconciled bill) for dual-use privileges.
Legislative Status — Bill Passed
The conference committee reconciled HB 642 and SB 542 into a final bill (HB642H3) on March 13, 2026. The House passed it 64-32 and the Senate 21-18 on March 14. The bill is now on Governor Spanberger's desk. She has 30 days to sign, veto, or return it with proposed amendments.

Before January 1, 2028, Virginia will issue up to 350 retail store licenses, 25 wholesaler licenses, 60 manufacturing licenses, and 5 Tier V cultivation licenses. Up to 100 early microbusiness licenses will be issued by December 1, 2026 to impact licensees, pre-2021 hemp registrants, and USDA-qualified farmers. After January 1, 2028, any license expansion must maintain parity — at least 50% of new licenses go to impact applicants.
The reconciled HB 642 establishes a Cannabis Equity Business Loan Fund to provide grants, low-interest loans, zero-interest loans, conditional loans, and technical assistance to qualified impact licensees. The fund is supported by 50% of deposits to the Cannabis Equity Reinvestment Fund. If the CCA uses a CDFI for loan administration, it must have a statewide Virginia presence and a proven track record of working with disadvantaged communities. Impact licensees may also qualify for fee waivers and a waiver of proof-of-funds requirements at application.
